Ask Slashdot: Copy Protection Advice For ~$10k Software? 635

An anonymous reader writes I'm part owner of a relatively small video editing software company. We're not yet profitable, and our stuff turned up on thePirateBay recently. Some of our potential paying customers are using it without paying, and some non-potential customers are using it without paying. Our copy protection isn't that tough to crack, and I'd rather see the developers working on the product than the DRM (I'm convinced any sufficiently desirable digital widget will get copied without authorization). Would it be insane to release a 'not for commercial use' copy that does some spying and reporting on you, along with a spy-free version for ~$10,000? I feel like that would reduce the incentive to crack the paid version, and legit businesses (In the US anyway but we're trying to sell everywhere) would generally pay and maybe we could identify some of the people using it to make money without paying us (and then sue the one with the biggest pockets). What would you do?"

Because of the nearly $2 million in funding, the budget is now large enough for language translations, voice acting, music, and more platforms. The XBox and PS3 are absent. I wonder what would the chances of a DRM-free release have been if funding had come from a traditional publisher?"

Thanks to DRM, Some Ubisoft Games Won't Work Next Week 332

hypnosec writes "Several of Ubisoft's biggest titles won't be playable as of next week thanks to a server move by the publisher and the restrictive DRM that was used in their development. This isn't just multiplayer either. Because Ubisoft thought it would be a smart plan to use always on DRM for even the single player portion of games like Assassin's Creed, even the single player portion of that title won't be playable during the server move. Some of the other games affected by this move will be Tom Clancy's HAWX 2, Might & Magic: Heroes 6 and The Settlers 7. The Mac games that will be broken during this period are Assassin's Creed, Splinter Cell Conviction and The Settlers. This move was announced this week as part of a community letter, with Ubisoft describing how the data servers for many of the publisher's online services would be migrated from third party facilities to a new location starting on the 7th February. The publisher didn't reveal how long the transfer would take."

Tenative Ruling Against Kaleidescape in DVD CCA Case 150

An anonymous reader wrote in with an update in the long drawn out legal proceedings between the DVD CCA and Kaleidescape, a manufacturer of a video jukeboxes. Despite a victory by Kaleidescape in 2007, they ended up back in court in November 2011. The DVD CCA insisted that ripping a DVD was in violation of the license granted to Kaleidescape; Kaleidescape disagreed since their jukebox made a bit-for-bit copy of the disc rather than first decrypting the contents. Unfortunately, in a preliminary ruling, the court agrees with the DVD CCA. Kaleidescape has released a statement.

Jailbreaking Could Soon Become Illegal Again 239

Diggester writes "Back in July 2010, the United States government approved a few exemptions in a federal law which made jailbreaking/rooting of electronic devices (iPhones and Android devices) legal. The court ruling stated that every three years, the exemptions have to be renewed considering they don't infringe any copyrighted material. The three-year period is due to expire and the Electronic Frontier Foundation (EFF) is looking to get the exemptions renewed. In order to do so, they have filed a petition which aims at government to declare jailbreaking legal once again. In addition to that, EFF is also asking for a change in the original ruling to include tablet devices." Here's the EFF's own page on the issue.

Pirate Party Releases Book of Pirate Politics 158

ktetch-pirate writes "If the SOPA/PIPA blackouts were a wakeup call to many people, then the U.S. Pirate Party has released a book that might help explain some of the issues. The book covers issues such as Corporate Personhood, the 4th Amendment, the history of copyright, and how DRM laws are made. There are even cartoons from Nina Paley throughout to add a bit of humor. DRM-free eBook versions are available to download from the book's site, or you can buy a paperback edition from Amazon for ten bucks." The book is under the CC BY-NC-SA, and features essays from the likes of Lawrence Lessig and Rick Falkvinge.

Ubisoft Has Windows-Style Hardware-Based DRM For Games 473

New submitter Man Eating Duck writes "Guru3D describes how the activation system in Ubisoft's RTS game Anno 2070 also tracks hardware changes: 'So yesterday I started working on a performance review. We know (well, at least we figured we knew), that the game key can be used on three systems. That's fair; the first activation is used on my personal game rig. The second we installed on the AMD Radeon graphics test PC and the 3rd on our NVIDIA graphics test PC. ... For the NVIDIA setup I take out the GTX 580, and insert a GTX 590. When I now startup the game, 'BAM', again an activation is required. Once again I fill out the key, and now Ubisoft is thanking me with the message that I ran out of activations.' Guru3D subsequently discovered that Ubisoft was less than helpful: 'Sorry to disappoint you — the game is indeed restricted to 3 hardware changes and there simply is no way to bypass that.' I, and many with me, will never buy games with such a draconian DRM scheme, as it's very likely that I'll swap out enough components to run into this issue. Even the Steam version includes this nice 'feature.' It's probably a good idea to let Ubisoft know why we'll pass on this title."

Microsoft Taking Aggressive Steps Against Linux On ARM 675

New submitter Microlith writes "Microsoft has updated their WHQL certification requirements for Windows 8, and placed specific restrictions on ARM platforms that will make it impossible to install non-Microsoft operating systems on ARM devices, and make it impossible to turn off or customize such security. Choice quotes from the certification include from page 116, section 20: 'On an ARM system, it is forbidden to enable Custom Mode. Only Standard Mode may be enabled' — which prevents users from customizing their security, and in section 21: 'Disabling Secure MUST NOT be possible on ARM systems' to prevent you from booting any other OSes."

US Survey Shows Piracy Common and Accepted 528

bs0d3 writes "A new U.S. survey sponsored by the American Assembly has revealed that piracy is both common and accepted. The surveys findings show that 46% of adults and 75% of young people have bought, copied, or downloaded some copyright infringing material. 70% of those surveyed said it's reasonable to share music files (PDF) with friends and family. Support for internet blocking schemes was at 16%."

Crysis 2 Most Pirated Game of 2011 383

MojoKid writes "When an advance copy of Crysis 2 leaked to the Internet a full month before the game's scheduled release, Crytek and Electronic Arts (EA) were understandably miffed and, as it turns out, justified in their fears of mass piracy. Crysis 2 was illegally download on the PC platform 3,920,000 times, 'beating out' Call of Duty: Modern Warfare 3 with 3,650,000 illegal downloads. Numbers like these don't bode well for PC gamers and will only serve to encourage even more draconian DRM measures than we've seen in the past."

'The last 20 years of Internet policy have been dominated by the copyright war, but the war turns out only to have been a skirmish. The coming century will be dominated by war against the general purpose computer, and the stakes are the freedom, fortune and privacy of the entire human race.'" Louis CK's Internet Experiment Pays Off 309

redletterdave writes "Comedian Louis C.K., real name Louis Szekely, took a major risk by openly selling his latest stand-up special, 'Louis C.K. Live at the Beacon Theater,' for only $5 on his website and refusing to put any DRM restrictions on the video, which made it easily susceptible to pirating and torrenting. Four days later, Louis CK's goodwill experiment has already paid off: The 44-year-old comic now reports making a profit of about $200,000, after banking more than $500,000 in revenue from the online-only sale. The special, which has sold 110,000 copies so far, is only available on Louis CK's website."

Microsoft Can Remotely Kill Purchased Apps 389

Meshach writes "The terms of service for Microsoft's newly launched Windows Store allows the seller to remotely kill or remove access to a user's apps for security or legal reasons. The story also notes that MS states purchasers are responsible for backing up the data that you store in apps that you acquire via the Windows Store, including content you upload using those apps. If the Windows Store, an app, or any content is changed or discontinued, your data could be deleted or you may not be able to retrieve data you have stored."

How Publishers Are Cutting Their Own Throats With eBook DRM 355

An anonymous reader writes "Sci-fi author Charlie Stross has written a post about how the Big Six book publishing companies have painted themselves into a corner in the rapidly growing ebook industry. Between user-unfriendly DRM and the Amazon juggernaut, they're slowly pushing themselves out of business. Quoting: 'Until 2008, ebooks were a tiny market segment, under 1% and easily overlooked; but in 2009 ebook sales began to rise exponentially, and ebooks now account for over 20% of all fiction sales. In some areas ebooks are up to 40% of the market and rising rapidly. (I am not making that last figure up: I'm speaking from my own sales figures.) And Amazon have got 80% of the ebook retail market. ... the Big Six's pig-headed insistence on DRM on ebooks is handing Amazon a stick with which to beat them harder. DRM on ebooks gives Amazon a great tool for locking ebook customers into the Kindle platform.'"

Valve's Gabe Newell On Piracy: It's Not a Pricing Problem 466

New submitter silentbrad writes with a followup to our discussion this morning about Ubisoft's claims of overwhelming game piracy. An article at IGN quotes a different point of view from Gabe Newell, CEO of Valve: "In general, we think there is a fundamental misconception about piracy. Piracy is almost always a service problem and not a pricing problem. For example, if a pirate offers a product anywhere in the world, 24 x 7, purchasable from the convenience of your personal computer, and the legal provider says the product is region-locked, will come to your country 3 months after the U.S. release, and can only be purchased at a brick and mortar store, then the pirate's service is more valuable. Most DRM solutions diminish the value of the product by either directly restricting a customers use or by creating uncertainty." The quote was taken from an interview at The Cambridge Student Online, in which Newell speaks to a few other subjects, such as creating games for multiple platforms and e-sports.

Ubisoft Blames Piracy For Non-Release of PC Game 424

New submitter Azmodan sends this excerpt from TorrentFreak: "Ubisoft is known for laying the blame for many problems on the unauthorized downloading of its games. Stanislas Mettra, creative director of the upcoming game I Am Alive, confirms this once again by saying that the decision not to release a PC version is a direct result of widespread game piracy. However, those who look beyond the propaganda will see that there appears to be more to the story than that." Another Ubisoft employee made similar comments about upcoming Ghost Recon games. Regarding Ghost Recon Online being free-to-play: "We are giving away most of the content for free because there’s no barrier to entry. To the users that are traditionally playing the game by getting it through Pirate Bay, we said, 'Okay, go ahead guys. This is what you’re asking for. We’ve listened to you – we’re giving you this experience. It’s easy to download, there’s no DRM that will pollute your experience.'" Regarding Future Soldier having no PC version: "When we started Ghost Recon Online we were thinking about Ghost Recon: Future Solider; having something ported in the classical way without any deep development, because we know that 95% of our consumers will pirate the game. So we said okay, we have to change our mind."

Secret BBC Documents Reveal Flimsy Case For DRM 199

mouthbeef writes "The Guardian just published my investigative story on the BBC and Ofcom's abuse of secrecy laws to hide the reasons for granting permission for DRM on UK public broadcasts. The UK public overwhelmingly rejected the proposal, but Ofcom approved it anyway, saying they were convinced by secret BBC arguments that couldn't be published due to 'commercial sensitivity.' As the article shows, the material was neither sensitive nor convincing — a fact that Ofcom and the BBC tried to hide from the public."

Microsoft Killing Silverlight? 324

Several industry insiders and partners for the last few weeks have heard from their own Microsoft sources that there won't be new versions released after Silverlight 5. Status on service packs and support for Silverlight is unclear, as Microsoft haven't yet released lifecycle support end date even for the previous Silverlight 4. By their support page they will give full year head-up before ending support. With Adobe ending development of Flash for mobile browsers and Microsoft ending development of Silverlight, HTML5 video looks a lot more promising. But will content providers be able to give out their material without DRM and how does HTML5 perform with non-video side of Flash and Silverlight?"
