The display is a larger version of the 3.5-inch control panel screens on HP's earlier Web-connected printers. The acquisition will be conducted by means of a cash tender offer for all of ArcSight's outstanding shares of common stock. The closing of the acquisition, which is subject to customary closing conditions, is expected to occur by the end of the calendar year."

The Wall Street Journal first reported the news, and has now posted the full text of the suit on Google Docs. Among other things, it says, 'In his new positions, Hurd will be in a situation in which he cannot perform his duties for Oracle without necessarily using and disclosing HP's trade secrets and confidential information to others.'"

Hurd resigned from HP a month ago, after an investigation by the board into a personal relationship with a contractor turned up questionable expenses. Oracle CEO Larry Ellison, a personal friend of Hurd, criticized HP's board at the time, saying it was 'the worst personnel decision since the idiots on the Apple board fired Steve Jobs.' 'Mark did a brilliant job at HP and I expect he'll do even better at Oracle,' Ellison said in a statement Monday. 'There is no executive in the IT world with more relevant experience than Mark.' Stepping down to make room for Hurd was Charles E. Phillips Jr., who had some personal relationship issues of his own."

Quoting the BBC: "HP says the first memristors should be widely available in about three years. The devices started as a theoretical prediction in 1971 but HP's demonstration and publication of a real working device has put them on a possible roadmap to replace memory chips or even hard drives. ... Steve Furber, professor of computer engineering at the University of Manchester, explained that the potential benefits lie in the fact that memristors are 'much simpler in principle than transistors. Because they are formed as a film between two wires, they don't have to be implanted into the silicon surface — as do transistors, which form the storage locations in Flash — so they could be built in layers in 3D,' he told BBC News. 'Of course, the devil is in the detail, and I don't think the manufacturing challenges have been fully exposed yet.'"

One could even say HP sniped the auction at the last minute — to the tune of $2 billion for the acquisition of data storage provider 3PAR. HP's not-so-subtle efforts to pull the company away from a preliminary merger agreement with Dell — a $1.15-billion arrangement announced August 16 — took three successive bids to reach an ultimate conclusion. The final acquisition cost of $2 billion, confirmed by 3PAR late Friday, represents a price of $30 per share of 3PAR stock. That's triple the closing price of the company's stock before Dell's initial offer was made public, and more than double after."

Users of dual-boot Windows/Linux installations may face the problem, which boils down to particular Windows applications (Colin does not name them, but users point at least to HP ProtectTools, PC Angel, Adobe Flexnet) blindly overwriting hard disk content between the MBR and the first partition destroying information already stored there, in this particular case — the 'core image' of GRUB 2 (GRand Unified Bootloader) making the system unbootable."

An investigation of ousted HP CEO Mark Hurd's surfing history reportedly convinced the HP Board that Hurd had had a personal relationship with sexual harassment accuser Jodie Fisher, even if not sexual. Just the latest example of how HP 'work[s] together to create a culture of inclusion built on trust, respect and dignity for all.' The WSJ reported a person close to the investigation said Hurd had looked at clips from racy films featuring Ms. Fisher, a former actress, while someone 'familiar with Mr. Hurd's thinking' said he merely did a Google search of 10 minutes or so. One wonders how many more 'personal relationships' with Ms. Fisher the browser histories of HP's 304,000 worldwide employees might reveal. BTW, nice to see that Hurd has made it to HP's ex-CEO-Hall-of-Fame page."

Wadhwa examines statistics surrounding job creation and innovation and while big companies may acquire startups and prove out the business model, the risk and true innovations seems to be living at the startup level almost exclusively. 'Now let's talk about innovation. Apple is the poster child for tech innovation; it releases one groundbreaking product after another. But let's get beyond Apple. I challenge you to name another tech company that innovates like Apple—with game-changing technologies like the iPod, iTunes, iPhone, and iPad. Google certainly doesn't fit the bill—after its original search engine and ad platform, it hasn't invented anything earth shattering. Yes, Google did develop a nice email system and some mapping software, but these were incremental innovations. For that matter, what earth-shattering products have IBM, HP, Microsoft, Oracle, or Cisco produced in recent times? These companies constantly acquire startups and take advantage of their own size and distribution channels to scale up the innovations they have purchased.'"

Stoobalou writes "A shareholding company launched a lawsuit against Hewlett-Packard's board of directors earlier this week, claiming they bungled their fiduciary duties over the departure of CEO Mark Hurd. 'The HP board put shareholders' finances at risk by not telling them about the sexual harassment inquiry, and then later rewarded Hurd with an estimated $40 million severance package, the suit said. The board also failed to adequately police insider trading by HP executives, allowing Hurd and chief financial officer Cathie Lesjak to sell off HP stock in the midst of the inquiry, according to the suit, which was filed in California Superior Court.'" HP is also facing increased scrutiny from the unrelated bribery probe that began earlier this year when their Moscow offices were raided.

Dick Lipton, a Professor of Computer Science at Georgia Tech, analyzed the idea of the proof on his blog. In a recent post, he explains that there have been many serious objections raised about the proof. The post summarizes the issues that need to be answered in any subsequent development, and additional concerns are raised in the comment section."

'The HP board just made the worst personnel decision since the idiots on the Apple board fired Steve Jobs many years ago,' Ellison wrote. For now, it seems that Rupert Murdoch is also standing by Hurd, who sits on News Corp's Board of Directors and its Corporate Governance Committee. Less likely to survive the scandal is Hurd's relationship with HP General Counsel Mike Holston, who accepted Hurd's signed separation agreement after leading an investigation into Hurd's actions, which Holston told the NY Times 'showed a profound lack of judgment.' Quite a change from just last year, when Hurd and Holston teamed up to get their daughters' elite prep school a state-of-the-art HP Data Center."

morsch writes "Researcher Vinay Deolalikar from HP Labs claims proof that P != NP. The 100-page paper has apparently not been peer-reviewed yet, so feel free to dig in and find some flaws. However, the attempt seems to be quite genuine, and Deolalikar has published papers in the same field in the past. So this may be the real thing. Given that $1M from the Millennium Prize is involved, it will certainly get enough scrutiny. Greg Baker broke the story on his blog, including the email Deolalikar sent around."

A number of readers are letting us know that HP CEO Mark Hurd just resigned over sexual harassment accusations. The company's board has appointed CFO Cathie Lesjak as interim CEO. A contractor had accused Hurd of sexual harassment, and the board brought in outside counsel to investigate. While the harassment claim could not be substantiated, the investigation did uncover other misconduct. Hurd's "close personal relationship" with the contractor created a conflict of interest, and he was also found to have misused company assets. In a statement, Hurd said, "As the investigation progressed, I realized there were instances in which I did not live up to the standards and principles of trust, respect and integrity that I have espoused at HP and which have guided me throughout my career."

The announcement 'demonstrates Oracle's commitment to openness,' company co-president Charles Phillips said in a statement."

MojoKid writes "The International Trade Commission has announced its findings in the NVIDIA/Rambus patent infringement lawsuit, and it's not the sort of ruling Team Green would've preferred. The commission found NVIDIA to be in violation of three Rambus patents. The trade panel also granted an injunction Rambus had requested, which theoretically prevents NVIDIA and the various companies attached to the lawsuit (Asus, HP, Palit, and MSI among others) from selling products that contain the infringing IP. The commission's decision this week affirms a January ruling that saw NVIDIA in violation of three Rambus patents while dismissing two additional claims of infringement Rambus made."
