Facebook Asks Court To Dismiss US Government, States Antitrust Cases (reuters.com) 22

Facebook asked a federal court on Wednesday to dismiss major antitrust cases filed by the U.S. Federal Trade Commission and nearly every U.S. state, saying they failed to show the company had a monopoly or harmed consumers. From a report: "By a one-vote margin, in the fraught environment of relentless criticism of Facebook for matters entirely unrelated to antitrust concerns, the agency decided to bring a case against Facebook," Facebook said in its response to the FTC complaint. "None of the harms typically alleged in antitrust actions is alleged here," it said. In lawsuits filed in December, the FTC and states asked the court to force the social media giant to sell two prized assets, its messaging app WhatsApp and photo-sharing app Instagram. U.S. District Judge James Boasberg in the District of Columbia will hear the cases.

    It's the first thing you do in such a case. Worst possible result if the Judge says "NO!!!", and you go to trial. Best case is you're done.

    So, no downside risk. So, why not?

    • But...Think of the lawyers!

      If the case gets dismissed out of hand, how will they rake in the millions of a long drawn out court proceeding?

    • The more obvious worst is that your legal costs go up, while pissing off the judge in a way that reduces your future ability to delay the case.

    How do those of us without FB account login in to those sites?
    This has even happened to a site I had an account on, they started requiring FB login.

    • I reluctantly use Google OAuth with a gmail burner account. Most sites (not Yahoo/VZ anymore) allow a throwaway mail.

      This is one of the more disastrous paths taken.

      Only way out would be to have a virtual machine you use for only that site and a FB account with very little personal info on it and no friends.

      • That won't stop Zuckfart LLC from scraping all sorts of data about you from the Internet.

        FB is crying foul. Like the boy who cried wolf.

        Disclaimer. I'm not on FB, Twitter etc. Never have been. Never will be.

        Any sites that require a FB or Google login don't get my patronage.

  • After all FB is making their job of spying on you so much easier.

    OTOH. FB's kicking people off in large numbers may be pissing the CIA off, in which case the case may go full steam ahead.

    What antitrust cases do they state?
