Mark Wilson quotes a report from BetaNews: The arrival of Fortnite on Android has not only been eagerly awaited, but also steeped in controversy. In addition to making the game a Samsung exclusive (for a few days, anyway), Epic Games decided to bypass Google Play and host APK downloads on its own servers. But this isn't going to stop people looking for Fortnite in the Play Store. Google is well aware of this, and that there is the potential for fake, scam apps to appear, tricking users into downloading something malicious. As such, the company is taking action, and is showing a warning to anyone who searches for Fortnite in Google Play. Conduct a search for Fortnite in Google's app store and you'll be greeted by a message that reads "Fortnite Battle Royale by Epic Games, Inc is not available on Google Play." Searchers are also advised that Fortnite rival PlayerUnknown's Battlegrounds (PUBG) is available to download.

Bethesda Blocks Resale of a Secondhand Game (polygon.com) 203

theshowmecanuck writes: Bethesda just pulled a cease and desist on an Amazon Marketplace sale of one of their games. This, despite the fact that the resale of used games is legal in the USA. Bethesda is saying that because it isn't being offered with a warranty, it is not protected through the First Sale Doctrine. UPDATE: The game in question was sealed and unopened, technically not "used," but being sold secondhand. In a letter sent to the seller by Bethesda's legal firm, they made the argument that the sale was not "by an authorized reseller," and was therefore "unlawful." Bethesda also took issue with the seller's use of the word "new" in selling the unwrapped game, claiming that this constituted "false advertising."

Bethesda offered the following statement: "Bethesda does not and will not block the sale of pre-owned games. The issue in this case is that the seller offered a pre-owned game as 'new' on the Amazon Marketplace. We do not allow non-authorized resellers to represent what they sell as 'new' because we can't verify that the game hasn't been opened and repackaged. This is how we help protect buyers from fraud and ensure our customers always receive authentic new product, with all enclosed materials and warranty intact. In this case, if the game had been listed as 'Pre-Owned,' this would not have been an issue."

Nintendo's Offensive, Tragic, and Totally Legal Erasure of ROM Sites (vice.com) 334

"The damage that removing ROMs from the internet could do to video games as a whole is catastrophic." From a report: In July, Nintendo sued two popular ROM sites, LoveROMS and LoveRetro.co, for what it called "brazen and mass-scale infringement of Nintendo's intellectual property rights." Both sites have since shut down. On Wednesday, another big, 18-year-old ROM site, EmuParadise, said it would no longer be able to allow people to download old games due to "potentially disastrous consequences." Nintendo owns the intellectual property for its games, and when people pirate them instead of buying a Nintendo Super NES Classic Edition or a downloading a copy from one of its digital storefronts, it can argue it's losing money. According to Nintendo's official site, ROMs and video game emulation also represent "the greatest threat to date to the intellectual property rights of video game developers," and "have the potential to significantly damage" tens of thousands of jobs. Even when a Nintendo game isn't for sale, it's still the company's intellectual property, and it can enforce its copyright if it wants.

But the damage that removing ROMs from the internet could do to video games as a whole is catastrophic. Many game developers and people who have otherwise made video games a major part of their lives, especially those who grew up in low-income households or outside a Western country, wouldn't have been inspired to take that path if it wasn't for ROMs. Entire chapters of video game history would be lost if ROMs and emulation didn't preserve games where publishers failed to. And perhaps most importantly, denying people access to ROMs makes the process of educating them in game development much more difficult, potentially hobbling future generations of video game makers.

Lawsuit Threat Shuts Down ROM Downloads On Major Emulation Site 'EmuParadise' (arstechnica.com) 79

Following Nintendo's recent lawsuits against ROM sites LoveROMs and LoveRetro, a major ROM repository called EmuParadise announced it will preemptively cease providing downloadable versions of copyrighted classic games. While no lawsuits have been filed yet, the site's founder, MasJ, writes in an announcement post: "It's not worth it for us to risk potentially disastrous consequences. I cannot in good conscience risk the futures of our team members who have contributed to the site through the years. We run EmuParadise for the love of retro games and for you to be able to revisit those good times. Unfortunately, it's not possible right now to do so in a way that makes everyone happy and keeps us out of trouble." Ars Technica reports: EmuParadise will continue to operate as a repository for legal downloads of classic console emulators, as well as a database of information on thousands of classic games. "But you won't be able to get your games from here for now," as MasJ writes. Since founding EmuParadise in 2000, MasJ says EmuParadise has faced threatening letters, server shutdowns, and numerous DMCA takedown requests for individual games. Through it all, he says he was encouraged by "thousands of emails from people telling us how happy they've been to rediscover and even share their childhood with the next generations in their families."

NEC Unveils Facial Recognition System For 2020 Tokyo Olympics (theverge.com) 25

NEC, a Japanese IT and networking company, announced plans to provide a large-scale facial recognition system for the 2020 Summer Olympic and Paralympic Games in Tokyo. "The system will be used to identify over 300,000 people at the games, including athletes, volunteers, media, and other staff," reports The Verge. From the report: NEC's system is built around an AI engine called NeoFace, which is part of the company's overarching Bio-IDiom line of biometric authentication technology. The Tokyo 2020 implementation will involve linking photo data with an IC card to be carried by accredited people. NEC says that it has the world's leading face recognition tech based on benchmark tests from the US's National Institute of Standards and Technology. NEC demonstrated the technology in Tokyo today, showing how athletes and other staff wouldn't be able to enter venues if they were holding someone else's IC card. The company even brought out a six-foot-eight former Olympic volleyball player to demonstrate that the system would work with people of all heights, though he certainly had to stoop a bit. It worked smoothly with multiple people moving through it quickly; the screen displayed the IC card holder's photo almost immediately after.

OpenAI's Bots Defeated Former Pro E-Sports Players At Dota 2 (theverge.com) 49

On August 5th, OpenAI's bots defeated four former professional Dota 2 players in two of the three matches played. "There were a few conditions to make the game manageable for the AI, such as a narrower pool of 18 Dota heroes to choose from (instead of the full 100+) and item delivery couriers that are invincible," reports The Verge. "But those simplifications did little to detract from just how impressive an achievement [the] win was." From the report: The OpenAI Five triumphed in convincing fashion in the first game, not allowing the human players to even destroy one of their defensive towers. The humans recovered a little in game two, conquering one tower, but they still got demolished. And finally, in a game three played purely for pride, the humans managed to squeeze out a win. What stands out when you watch the matches is the apparent intelligence of the AI's decisions and the inhuman absence of any indecision. The typical Dota 2 game, even on the professional tier, involves quite a bit of equivocation about whether to engage in a fight, try and shift it to a more favorable battleground, or run away from it completely. The OpenAI team just doesn't need the processing time that humans require, which made its play appear unnatural -- but only in the speed and crispness of the decision-making, not in the content of those decisions.

Citing 'Economic Efficiency,' Epic Says Fortnite's Upcoming Android App Won't Hit Google Play Store (theverge.com) 131

Fortnite developer Epic Games will not be distributing its massively popular game on Android because the Play Store takes a 30 percent cut of the revenue. Instead, the company plans to distribute the software to players via the official Fornite website, "where Android users can download a Fortnite Installer program to install the game on compatible devices," reports The Verge. From the report: For Fortnite on iOS, Epic decided to distribute the game on the App Store, most likely because it had no other method of getting iPhone users to easily download the software. (Apple, unlike Google, does not allow iOS users to download apps that are not first approved by its internal review processes and distributed through its proprietary marketplace.) With Google and its more open platform, Epic can get away with distributing the app itself. CEO Tim Sweeney says the primary motivation here is twofold. Epic wants to maintain its direct relationship with consumers. (The company currently distributes Fortnite on PC through its own Epic Games Launcher, instead of using Valve's popular Steam platform.)

The second reason is financial: Epic does not want to pay Google's 30 percent cut, especially considering the entire game is funded through in-app purchases. "The 30 percent store tax is a high cost in a world where game developers' 70 percent must cover all the cost of developing, operating, and supporting their games," Sweeney says. "There's a rationale for this on console where there's enormous investment in hardware, often sold below cost, and marketing campaigns in broad partnership with publishers." But on mobile platforms that are open, like Android, "30 percent is disproportionate to the cost of the services these stores perform, such as payment processing, download bandwidth, and customer service," he says. Sweeney adds that Epic is "intimately familiar with these costs" from its direct distribution of Fortnite on Mac and PC.
There's no word as to when the Android version of Fortnite will be available, but rumors suggest it will be tied to the upcoming Samsung Galaxy Note 9 launch on August 9th.

The NES Classic Outsold the PS4, Xbox One, and Switch In June (theverge.com) 128

After returning to stores in June after a brief stint of sales back in 2016, the NES Classic is topping U.S. sales charts. Market research firm NPD reports that the NES Classic was June's highest unit-selling hardware platform in the U.S., beating the PlayStation 4, Nintendo Switch, and Xbox One. "The NES Classic managed to outsell these consoles despite only being on sale for a few days in late June," reports The Verge. From the report: While the NES Classic is priced at $59 compared to more expensive current-generation consoles, it's clearly still in demand 35 years after the original Nintendo Entertainment System debuted in 1983. The NES Classic comes loaded with 30 games including classics like Super Mario Bros., Metroid, Donkey Kong, The Legend of Zelda, and Pac-Man. While you can't insert vintage NES cartridges into it, the console supports game saves and connects to TVs via a HDMI cable. Nintendo hasn't revealed whether it now plans to introduce more miniature retro consoles.

Tesla Is Adding Atari Games To the In-Car Display (theverge.com) 156

In the next software update for its vehicles, Tesla will include several playable Atari games as new Easter eggs. CEO Elon Musk said the update would be released in "about four weeks" and should include games like Pole Position, Tempest, and Missile Command. The Verge reports: Pole Position's controls will apparently be linked to the Tesla's actual steering wheel -- while the vehicle is stopped, Musk made clear. It goes without saying, but no one should be messing around with any of these when they're behind the wheel of a moving car. A much bigger deal for Tesla owners is that, according to Musk, software version 9.0 will begin to enable "full self-driving features" in eligible vehicles. The new update might be discussed further during Tesla's earnings call later today.

Steam Game Pulled From Store After Allegations of Cryptocurrency Mining (polygon.com) 26

Valve decided to remove a game from Steam after it was found to be turning players' computers into cryptocurrency miners. An anonymous reader shares the report from Polygon: The game is called Abstractism, which was said to not only infiltrate players' computers with mining software, but also dupe them through falsified items on the Steam Marketplace. But not long after these accusations started circulating, it has been taken off Steam. When Abstractism was up on the store, it was marketed as a "relaxing" platformer with a simple design. But YouTuber SidAlpha noticed that something was afoot, when someone on the Team Fortress 2 forums posted about how the game was tied into an item scam.

Players also noticed that the game used massive amounts of CPU and GPU, which Abstractism's developers claimed was because of the game's "high graphics settings," something quite uncharacteristic for a simple platformer. High CPU and GPU usage is another tell-tale sign that a computer is being used to mine cryptocurrency. Just hours after SidAlpha's video and the associated forum posts began to spread, Valve removed Abstractism from Steam, and the developer has been banned from Steam. All previously purchased Abstractism items have been tagged with "This item can no longer be bought or sold on the Community Market."

New Zealand Government Spends $150K To Create Video Game To Teach People How To Run a Business (nzherald.co.nz) 94

The New Zealand government spent at least $150,000 to create a video game that shows people how to run their own business. It reportedly took 14 months and eight designers to create. NZ Herald reports: The Tycoon Game series, which consists of Restaurant Tycoon and Tech Tycoon, challenges players to use what the World Economic Forum has deemed as 10 essential skills vital for the future of employment. The educational game will teach players business skills including emotional intelligence and cognitive flexibility, as well as critical thinking and creativity -- skills the Forum has this year bumped up the prescribed list. Players can level-up and earn badges for certain achievements, determined by how they manage scenarios in the game, including paying supplier invoices and wages. Microsoft's Next-Gen Xbox Will Focus On 'XCloud' Game Streaming (theverge.com) 127

One big area that Microsoft is focusing on with its next-generation Xbox is game streaming. According to a report from Thurrott.com, Microsoft is working on two new Xbox consoles. The "Xbox Two" will be a console similar to that of the Xbox One and Xbox 360, with updated hardware and specs. The other Xbox console in development will be limited to streaming games. The Verge reports: The streaming-only console will reportedly include a low amount of local compute for handling tasks like controller input, image processing, and collision detection. These tasks are essential to reducing latency in game streaming, and Microsoft is said to be planning to slice up processing between the game running locally and in the cloud in order to reduce input lag and other image processing delays. Microsoft is currently developing its next-generation Xbox console under the Scarlett codename. The software giant recently revealed it's also working on a game streaming service for Xbox that will work across any device. This is a key part of Microsoft's future plans with Xbox, and part of the company's vision for developing its "Netflix for video games" service, Xbox Game Pass.

Sources familiar with Microsoft's plans tell The Verge that Microsoft is currently "all hands" on creating datacenters capable of powering the company's game streaming service. Referred to as codename "XCloud" internally, Microsoft has been experimenting with combining four lots of custom Xbox consoles into a single server blade for its datacenters. These servers will launch initially with developers in mind to build and develop games in the cloud instead of local debug machines, and then to stream games to consumers.

Nintendo To ROM Sites: Forget Cease-and-Desist, Now We're Suing (arstechnica.com) 296

An anonymous reader quotes a report from Ars Technica: Nintendo's attitude toward ROM releases -- either original games' files or fan-made edits -- has often erred on the side of litigiousness. But in most cases, the game producer has settled on cease-and-desist orders or DMCA claims to protect its IP. This week saw the company grow bolder with its legal action, as Nintendo of America filed a lawsuit (PDF) on Thursday seeking millions in damages over classic games' files being served via websites. The Arizona suit, as reported by TorrentFreak, alleges "brazen and mass-scale infringement of Nintendo's intellectual property rights" by the sites LoveROMs and LoveRetro. These sites combine ROM downloads and in-browser emulators to deliver one-stop gaming access, and the lawsuit includes screenshots and interface explanations to demonstrate exactly how the sites' users can gain access to "thousands of [Nintendo] video games, related copyrighted works, and images." The biggest amount of money Nintendo is seeking comes from "$150,000 for the infringement of each Nintendo copyrighted work and up to $2,000,000 for the infringement of each Nintendo trademark." The company has also requested full disclosure of the operators' "receipts and disbursements, profit and loss statements, advertising revenue, donations and cryptocurrency revenue, and other financial materials."

LoveROMs has since removed all Nintendo-affiliated links, including ROMs and emulators, and the site announced on its social media channels that "all Nintendo titles have been removed from our site." Meanwhile, LoveRetro.co now redirects visitors to a page that reads: "Loveretro has effectively been shut down until further notice."

Undark titled their piece "a mansion filled with hidden worlds: when the internet was young," describing the mansion's halls as "really just a string of code, where people once lived, and still do, in some way or another, as someone must, until the server winks out." I logged in a few times in 1997, so I'm probably in there too...

The article describes reading a Usenet newsgroup about MUDs back in 1990. "Approximately half of the contributors thought it was a game; the other half vehemently and heatedly disagreed."

Hello Games Received Death Threats Over 'No Man's Sky' (theguardian.com) 196

The Guardian revisits the disastrous 2016 launch of the massive open-universe videogame No Man's Sky, in a new interview with company director Sean Murray: "I've never liked talking to the press. I didn't enjoy it when I had to do it, and when I did it, I was naive and overly excited about my game. There are a lot of things around launch that I regret, or that I would do differently." He is reluctant to relive the particulars of what happened in the weeks and months following No Man's Sky's release in August 2016 ("I find it really personal, and I don't have any advice for dealing with it," he says), but it involved death threats, bomb threats sent to the studio and harassment of people who worked at Hello Games on a frightening scale. They were in regular contact with Scotland Yard and the Metropolitan police... "I remember getting a death threat about the fact that there were butterflies in our original trailer, and you could see them as you walked past them, but there weren't any butterflies in the launch game. I remember thinking to myself: 'Maybe when you're sending a death threat about butterflies in a game, you might be the bad guy....'"

Despite the controversy, No Man's Sky sold extremely well, and plenty of its players have stuck by it. A year after release, when Hello Games released the Atlas Rises update, about a million people showed up to play, and the average playtime was 45 hours.... It is still recognisable as the lonely, abstractly beautiful space-exploration game I played in 2016, but three big updates have added a lot more. It is now definitely a better game, with much more to do and a clearer structure... Now you can also construct bases, drive around in vehicles and -- as of next week -- invite other players to explore with you, in groups of four. You can crew a freighter together, or colonise a planet with ever-expanding constructions.

"You are still a tiny speck in an infinite universe," writes the Guardian. "it's just that now, you have some company." Murray describes it as a "Star Trek away team vibe."

In another interview, Murray concedes that during the five years they'd spent in development, "We talked about the game way earlier than we should have talked about the game.... "

Amazon Responds After Third-Party Sellers Put Bootleg Games on Its Store (venturebeat.com) 91

Jeff Grubb, reporting for VentureBeat: Over the weekend, some thrifty gamers spotted a deal on Amazon. A downloadable version of the tough strategy survival sim Frostpunk was available on the Amazon Marketplace from a third-party seller for $3, which is a 90 percent discount from the standard $30 price. But after looking into the game, some customers who dropped the three bucks had some questions. For example, why does the metadata for this version of Frostpunk refer to the DRM-free version that people can buy from GOG. [...] So I reached out to Amazon, and it provided the following statement from a company spokesperson: "Our customers trust that when they make a purchase through Amazon's store --either directly from Amazon or from its third-party sellers -- they will receive authentic products, and we take any claims that endanger that trust seriously. We strictly prohibit the sale of counterfeit products, and these games have been removed." That's all it would say on this.

Saudi Arabia Bans 47 Games In Response To Two Child Suicides (ign.com) 98

An anonymous reader quotes a report from IGN: Saudi Arabia is apparently banning 47 games in response to a pair of children committing suicide after allegedly being encouraged to do so while playing an online game. Per the Associated Press, the Saudi General Commission for Audio-Visual Media said yesterday that a 13-year-old girl and a 12-year-old boy have taken their own lives after playing a social media game known as Blue Whale. Also called the Blue Whale Challenge, the disturbing social media phenomenon is a form of extreme cyberbullying. It's not clear how the Saudi government believes this connects to more mainstream video games, but it nonetheless appears to have banned 47 popular indie and AAA games in response.The Saudi General Commission for Audio-Visual Media's website actually says the list of banned games was last updated on July 2, but the Associated Press' report claims the bans were just announced Monday.

Now, more than a century later, children can try and find it themselves, with the bays and mountains of Stevenson's fictional island given a blocky remodeling in Minecraft, as part of a new project aimed at bringing reluctant readers to literary classics. From Spyglass Hill to Ben Gunn's cave, children can explore every nook and cranny of Skeleton Island as part of Litcraft, a new partnership between Lancaster University and Microsoft, which bought the game for $2.5 billion in 2015 and which is now played by 74 million people each month. The Litcraft platform uses Minecraft to create accurate scale models of fictional islands: Treasure Island is the first, with Michael Morpurgo's Kensuke's Kingdom just completed and many others planned. [...] The project, which is featured on Microsoft's Minecraft.edu website, is currently being presented to school teachers and librarians across the UK. There has been "an enthusiastic response" to the trials under way in local schools, with plans to roll Litcraft out to libraries in Lancashire and Leeds from October 2018.

The blockchain gaming company Lucid Sight is partnering with Major League Baseball to launch MLB Crypto Baseball. Engadget's Daniel Roberts explains: Ethereum, launched in 2015, is a decentralized platform for "smart contracts," which are automated agreements for an exchange of value. It runs on a blockchain, the same peer-to-peer, immutable, public ledger technology that bitcoin runs on. The cryptocurrency of Ethereum is ether. Because of Ethereum's usefulness for smart contracts, it has become a proving ground for blockchain-based games, where users collect and trade one-of-a-kind items that no one can duplicate or steal. On a blockchain, each digital item (or contract) is verified and tamper-proof.

In MLB Crypto Baseball, users will pay in ether to buy digital avatars tied to specific moments in recent games. They can then sell the items, or in some cases, earn rewards and stickers. The game is a decentralized app, or "dApp." [...] To play the game at launch, users must own some amount of ether and must transfer it to a web plug-in called MetaMask. (CryptoKitties works the same way.) Lucid Sight hopes to have an easy mobile app ready shortly after launch. "We are not building this just for tech savvy people," says Lucid Sight cofounder Octavio Herrera. "That said, the game will roll out in stages. So yes, for version 1 you will need ether, you will need MetaMask, it will be a little bit difficult to get into. But I do think people will open up Coinbase accounts, buy some ether, and transfer it to MetaMask, in order to collect these things they'll enjoy so much."

Game Company Fires Two Employees Who Complained About 'Mansplaining' on Twitter (theverge.com) 1056

An anonymous reader quotes the Verge: On July 3rd, narrative designer Jessica Price tweeted a 29-tweet thread dissecting the challenges of writing player characters in an MMORPG. A streamer who goes by Deroir responded, "Really interesting thread to read! However, allow me to disagree slightly," and shared a three-tweet explanation of how narrative design influences player expression in the sort of games that Price narratively designs. Price both replied directly to Deroir, tweeting "thanks for trying to tell me what we do internally, my dude," and retweeted his response with the caption "today in being a female game dev: 'Allow me -- a person who does not work with you -- to explain to you how you do your job....'"

Price's suggestion that Deroir was mansplaining game development -- an area where he does not have the same knowledge or experience -- sparked anger among the ArenaNet community. She subsequently responded to those criticizing her on Twitter. [Here's the first lines of that tweet. "Since we've got a lot of hurt manfeels today, lemme make something clear: this is my feed. I'm not on the clock here. I'm not your emotional courtesan just because I'm a dev. Don't expect me to pretend to like you here. The attempts of fans to exert ownership over our personal lives and times are something I am hardcore about stopping."] Price was fired shortly after. Although many fans are comparing this to something like working in a restaurant -- be polite to the customer, or get fired -- Price says it's impossible to talk about this incident without larger context about systematic online harassment, particularly the sometimes abusive relationship between fans and game developers and the failure of game companies to address it. "Game companies are generally unwilling to be honest with themselves about how they're complicit in creating and sustaining that environment," she tells The Verge...

Price adds that she believes her firing was an emotional reaction on the part of ArenaNet co-founder Mike O'Brien. "He fired me personally, and the meeting was mostly him venting his feelings at me," she says. "I understand being afraid when you see the Reddit mob coming for you, but if people with less power can weather it -- and we do, regularly -- so can he...."

"We can probably fire anyone on the GW2 dev team as long we make a big enough stink," wrote one user on the Guild Wars 2 subreddit. "Nobody at Arenanet is safe from the hand of reddit. We're literally running the company now..." UPDATE (7/12/18): That user eventually clarified that their remark was satirical, identifying themself as an angry Reddit user who felt powerless and "surrounded by individuals who are so thoughtless and shitty I was hoping I'd appeal to some sort of sense of decency by writing the most vile shit I could think of... I took it down because I realized that nobody was going to disagree with me."

ArenaNet also fired Peter Fries, a writer who'd worked for them for 12 years, apparently for defending Price in a series of now-deleted tweets. (For example, "Here's a bit of insight that I legitimately hope [Deroir] reflects on: she never asked for his feedback.")

"The message is very clear, especially to women at the company," Jessica Price tells the Verge. "If Reddit wants you fired, we'll fire you. The quality of your work doesn't matter."
