Sony Makes It Hard To Develop For the PS3 On Purpose 616

adeelarshad82 writes "CNet reports on a bizarre comment from Sony's Computer Entertainment CEO in response to complaints from developers on how hard it is to develop games for the Playstation 3. 'We don't provide the "easy to program for" console that (developers) want, because "easy to program for" means that anybody will be able to take advantage of pretty much what the hardware can do, so then the question is, what do you do for the rest of the nine-and-a-half years?' Given that games heavily drive console sales, and the fact that the PS3 is already 8 million units behind the Xbox 360, I think making a developer's job harder is the last thing Sony needs."

Amazon Caves On Kindle 2 Text-To-Speech 370

On Wednesday we discussed news that the Authors Guild had objected to the text-to-speech function on Amazon's Kindle 2, claiming that it infringed on audio book copyright. Today, Amazon said that while the feature is legally sound, they would be willing to disable text-to-speech on a title-by-title basis at the rightsholder's request. "We have already begun to work on the technical changes required to give authors and publishers that choice. With this new level of control, publishers and authors will be able to decide for themselves whether it is in their commercial interests to leave text-to-speech enabled. We believe many will decide that it is."

Book Publishers Making the Same Mistakes as Record Labels? 227

Techdirt points out an interesting query in Slate asking why book publishers appear to be making the same mistake that record labels did with the iTunes service with DRM, and single-vendor lock-in. "Back in 2005, we noted that Apple's dominance over the online music space, which upset the record labels tremendously, was actually the record labels' own fault for demanding DRM. That single demand created massive lock-in and network effects that allowed Apple to completely dominate the market. If the record labels had, instead, pushed for an open solution, then anyone else could have built stores/players to work as well, and it could have minimized Apple's ability to control the market. Yes, everyone is now opening up (including Apple), but it took a long time, and Apple had already established its dominant position. So why are book publishers doing the same thing?"

Google Dev Phone 1 Banned From Paid Apps 134

ScrewMaster points out an short article according to which purchasers of the G1 Android phone's developer-oriented variant will be out of luck if they want to buy apps from Google's application store. "Google is not going to allow programmers who have purchased the Dev Phone 1 to purchase paid apps from the Android Market. I just signed up as a G1 developer, and was about to plunk down the $399 for a Dev Phone 1, but now I'm going to have to think about it. I know that Google is interested in preventing (cough) 'piracy,' but does this seem like the right way to go? I know the Dev Phone 1 is primarily a developer's tool, but I would like to actually use the thing, and not have to spend another $180 from T-Mobile for a regular G1 just for the privilege of buying software." I hope this isn't true; the unlocked G1 looked like a pretty cool phone, especially (being unlocked) for travel to countries where pre-paid SIM cards are the norm.

OCO is the first earth science observatory that will create a detailed map of atmospheric carbon dioxide sources and sinks around the globe. And not a moment too soon. Popular Mechanics has a concise article on the science that this mission will perform, and how it fits in with the existing 'A-train' of polar-orbiting earth observatories. The new software allows PC users to swap files with the computers of friends, family, and trusted colleagues along safe, secure channels. Dubbed 'Windows Live ID Sign-in Assistant 6.5,' the beta connects the Windows Live IDs of individual users with a Windows 7 account, essentially building a secure link between data stored on a hard drive and information accessible via Windows Live online."

Draconian DRM Revealed In Windows 7 1127

TechForensics writes "A few days' testing of Windows 7 has already disclosed some draconian DRM, some of it unrelated to media files. A legitimate copy of Photoshop CS4 stopped functioning after we clobbered a nagging registration screen by replacing a DLL with a hacked version. With regard to media files, the days of capturing an audio program on your PC seem to be over (if the program originated on that PC). The inputs of your sound card are severely degraded in software if the card is also playing an audio program (tested here with Grooveshark). This may be the tip of the iceberg. Being in bed with the RIAA is bad enough, but locking your own files away from you is a tactic so outrageous it may kill the OS for many persons. Many users will not want to experiment with a second sound card or computer just to record from online sources, or boot up under a Linux that supports ntfs-3g just to control their files." Gamers, EFF Speak Out Against DRM 203

Last month, we discussed news that the FTC would be examining DRM to see if it needs regulation. They set up a town hall meeting for late March, and part of that effort involved requesting comments from potential panelists and the general public. Ars Technica reports that responses to the request have been overwhelmingly against DRM, and primarily from gamers. The Electronic Frontier Foundation also took the opportunity to speak out strongly against DRM, saying flat out that "DRM does not prevent piracy," and suggesting that its intended purpose is "giving some industry leaders unprecedented power to influence the pace and nature of innovation and upsetting the traditional balance between the interests of copyright owners and the interests of the public." Their full public comments (PDF) describe several past legal situations supporting that point, such as Sony's fight against mod chips, Blizzard's DMCA lawsuit against an alternative to battle.net, and Sony's XCP rootkit.

Apple Claims That Jail-Breaking Is Illegal 610

rmav writes "Apple has finally made a statement about jail-breaking. They try to sell the idea that it is a copyright infringement and DMCA violation. This, despite the fact (as the linked article states) that courts have ruled that copying software while reverse engineering is a fair use when done for purposes of fostering interoperability with independently created software. I cannot help but think that the recent flood of iPhone cracked applications is responsible for this. Before that, Apple was quietly ignoring the jailbreak scene. Now, I suppose that in the future we may only install extra applications on our iPhones as ad hoc installs using the SDK, and if we want turn-by-turn directions, tethering, and the like, we have to compile these apps by ourselves? Maybe we should go and download the cydia source code and see what we can do with it."

Average User Only Runs 2 Apps, So Microsoft Will Charge For More 842

Barence writes "Microsoft's decision to limit Windows 7 Starter Edition to running only three concurrent applications could force up the price of netbooks as many manufacturers opt for the more expensive Home Premium. The three-app rule includes applications running in the background but excludes antivirus, and the company claims most users wouldn't be affected by the limit. 'We ran a study which suggested that the average consumer has open just over two applications [at any time]. We would expect the limit of three applications wouldn't affect very many people.' However, Microsoft told journalists at last year's Professional Developers Conference that 70% of Windows users have between eight and 15 windows open at any one time."

Will the FTC Target EULAs Next? 116

A few weeks ago, we discussed news that the Federal Trade Commission was planning to look into DRM and the way its characteristics are communicated to customers. Now, Joystiq's Law of the Game column speculates that EULAs could be on the FTC's list to review as well. "I would be willing to guess that within the next few years, the often maligned End User License Agreement ('EULA') may fall into the realm of being regulated as further 'consumer protection.' Is it necessary? ... The first and most common method [of consumer protection] is what is known as a 'plain language requirement.' The idea is that contracts written by lawyers are full of legal terms and are written in such a way that it takes a lawyer to decipher the actual meaning of all of the clauses. ... on the complete opposite end of the spectrum, it could be required that companies abandon EULA contracts all together in favor of a collection of FTC approved bullet points. The development and legal communities would, I assume, vehemently oppose this idea, but it is possible. Basically, the FTC would come up with a list of things all EULAs include, then a list of optional provisions that the licensor (the game company) could include."

Microsoft Brings Back DRM 414

Barence writes "Microsoft yesterday unveiled its MSN Mobile Music service — and a surprise return to digital rights management (DRM). While companies such as Apple and Amazon have finally moved to music download services free of copy protection, MSN Mobile locks tracks to the mobile handset they are downloaded to. It also charges more than the other services per track, and offers no way to transfer your tracks to your new phone when you upgrade. The company's Head of Mobile UK spoke to PC Pro about the launch, but his answers are almost as baffling as the service itself. Best quote: Q: 'If I buy these songs on your service — and they're locked to my phone — what happens when I upgrade my phone in six months' time?' A: 'Well, I think you know the answer to that.'"

Valve Takes Optimistic View of Piracy 509

GameDaily recently spoke with Jason Holtman, director of business development and legal affairs for Valve, about online sales and piracy. Holtman took a surprising stance on the latter, effectively taking responsibility for at least a portion of pirated games. Quoting: "'There's a big business feeling that there's piracy,' he says. But the truth is: 'Pirates are underserved customers. When you think about it that way, you think, "Oh my gosh, I can do some interesting things and make some interesting money off of it." We take all of our games day-and-date to Russia,' Holtman says of Valve. 'The reason people pirated things in Russia,' he explains, 'is because Russians are reading magazines and watching television — they say "Man, I want to play that game so bad," but the publishers respond "you can play that game in six months...maybe." We found that our piracy rates dropped off significantly,' Holtman says." Attitudes like this seem to be prevalent at Valve; last month we talked about founder Gabe Newell's comments that "most DRM strategies are just dumb."

iTunes DRM-Free Files Contain Personal Info 693

r2k writes "Apple's iTunes Plus files are DRM-free, but sharing the files on P2P networks may be an extremely bad idea. A report published by CNet highlights the fact that the account information and email address of the iTunes account holder is hidden inside each and every DRM-free download. I checked, and I found I couldn't access the information using an ID3 tag editor, but using Notepad I found my email address stored inside the audio file itself."

Federal Trade Commission To Scrutinize DRM 211

Ars Technica reports that the FTC is getting ready to take a hard look at gaming DRM, setting up a town hall meeting to be held on March 25th. They're currently recruiting panelists, and they say the meeting will, in part, "address the need to improve disclosures to consumers about DRM limitations." The controversy over DRM came to a head in 2008 with the release of Spore and the multiple subsequent class-action lawsuits focusing on the SecuROM software that came with the game. Ars Technica says the town hall meeting will also look at "legal issues surrounding DRM" and "the potential need for government involvement to protect consumers."

Apple Intros 17" Unibody MBP, DRM-Free iTunes 1079

Phil Schiller delivered the keynote at MacWorld, the first after the Steve Jobs era of keynotes. Here is Engadget's live blog. The big news, predicted by many rumor sites, was the introduction of the unibody 17" MacBook Pro. As rumored, the battery is not removable, but it's claimed to provide 8 hours of battery life (7 hours with the discrete graphics): "3x the charges and lifespan of the industry standard." $2,799, 2.66 GHz and 4 GB of RAM, 320GB hard drive, shipping at the end of January. There is a battery exchange program, and there is an option for a matte display. The other big news is that iTunes is going DRM-free: 8M songs today, all 10+M by the end of March. Song pricing will be flexible, as the studios have been demanding; the lowest song price is $0.69. Apple also introduced the beta of a Google Docs-like service, iWork.com.
